Human beings have a great variety of rights which we can find enclosed within human rights which at the same time are inseparable from all human beings, regardless of their nationality , sex , national or ethnic origin , color , religion , language or any other state. These rights cannot be given or taken away. One of these important benefits is the right to education , to which we are entitled from when we are children and even when we reach adulthood .

Education is considered a right human and universal that must be accessible to all people in the world without applying any kind of discrimination , which must be initiated from the school and must be available to all enabling children this way to learn to read and write . It is a fundamental right for the adequate development of the human being both socially and economically , and is considered an important element to achieve the development of peace and sustainable development promoting well-being. individual and collective.

The origin of the right to education is born together with philosophical thought where it had a central role. Basically it is a right that originates from the prehistoric period when men were looking for a way to educate their descendants.


The right to education is a fairly recent right in the world. The history of this right can be divided into three different stages . The first one occurred when there was segregation , in other words, the right to education was granted to people who had not been previously recognized . At this stage, the right began to be given to those who had previously been denied.

The second stage in the history of law was based on educational segregation, moving towards a proposal for integration . The groups had to adapt to the schooling that existed, regardless of their mother tongue, religion , ability or disability.

During the third stage, which is the one we are currently experiencing, a type of adaptation to the teaching of diversity is sought by introducing adaptation to the teaching of equal law of education for all.

The right to education is stipulated in article 67, which says that education is a right of the person and at the same time a public service that has a social function seeking knowledge , science , technique and values of culture. It mentions that the State , society and the family are responsible for education, which is compulsory from five to fifteen years of age, including one year of preschool and nine years of basic education.. In addition, the State is responsible for ensuring its quality and for the fulfillment of its purposes.


With the reform of article 3 of the Mexican constitution, the recognition of education as a quality service and as a human right that must comply with the human rights principles of universality , indivisibility , interdependence and progressiveness was introduced .
